2009 yillinda Telecom Egypt Club kendi ülke federasyonuna Egyptian Football Association (EFA) dava acmis.

Ben kisaca özetleyeyim.

2008/2009 yilinda 2 takim ligden düsmemeye oynuyormus. Biri 29 puanda digeri 30 puanda. Sonra bu 30 puandaki takim son maci yenerek ligden düsmeyi kurtulmus. Ama nasil yenmis? Karsi takimin kalecisi kendi kalesine gol atmis 24. dakikada. Macta 2:0 bitmis.
Bu macta sike var diye dava acmislar. Örnek olarakta macin videosunu vede kendi kalesine gol attiginda hakemin süphe duyarak kullakligina bir seyler söylemis oldugunu gösteriyorlar.

Bakin burda cok ama cok önemli bir icerik var bu basvuru ile ilgili:

13. In this connection, the Panel also refers to the case CAS 2008/A/1525, where the CAS panel ruled that it had jurisdiction to decide a dispute between a professional football club and its national association. The “point de départ” was again a provision expressly establishing a right for legal recourse to CAS, this time contained in the applicable regulations of the HFF:
“The reference to the Court for Arbitration of Sports (CAS) is permitted past the conclusion of all levels of jurisdiction of the Hellenic Football Bodies, under the terms and conditions stated in the Statutes of the HFF and UEFA” (emphasis added by the Panel).
14. The Panel finds that no equivalent provision can be found in the regulatory framework of the EFA, no matter which of the versions supplied by the parties (see below) applies.

Eger bir federasyonun statüsünde gecerli bir madde var ise, o zaman CAS rahatlikla icisleri ile ilgili konulara bakabiliyorlar.

Misir federasyonunda böyle bir madde olmadigi icin, aksine Yunanlilarda varmis, bu Misir takimin basvurusunun temel dayanagi bulunmamaktadir.

Yanlis anlamadiysam eger iki tarafta kabul ederse (yada etseydi), CAS bu davaya bakabilecegini söylüyor (yani o federasyon kabul etseydi, dava gerceklesecekti). Bunuda arada not olarak gecmisler.

Appeal of Egyptian club Al-Masry partially upheld

Lausanne, 26 July 2012 - The Court of Arbitration for Sport (CAS) has partially upheld the appeal filed by the Egyptian club Al-Masry against the Egyptian Football Association in relation to the tragedy of Port-Saïd which occurred in February this year.

On 24 April 2012, the EFA Appeal Committee issued a decision in which Al-Masry was sanctioned following The Court of Arbitration for Sport (CAS) has partially upheld the appeal filed by the Egyptian club Al-Masry against the Egyptian Football Association in relation to the tragedy of Port-Saïd which occurred in February this year.

On 24 April 2012, the EFA Appeal Committee issued a decision in which Al-Masry was sanctioned following incidents which took place during the match between Al-Ahly and Al-Masry on 1 February 2012. Pursuant to such decision, Al-Masry was banned from participating in any EFA events for the season 2012/2013 and was relegated to the second Egyptian league for the season 2013/2014 with fans excluded from attending both home and away matches. Furthermore, Al-Masry was banned from holding any games in its stadium (the Port Said Stadium) for four calendar years.

On 17 May 2012, Al Masry filed an appeal against the EFA Appeal Committee decision at the CAS. The case was referred to a Panel of three arbitrators. The representatives of Al-Masry were heard at a hearing at the CAS Court Office on 20 July 2012. The Egyptian Football Association chose not to participate in the CAS procedure.

On 23 July 2012 the Panel issued its decision that the appeal has been partially upheld and the new decisions in place are as follows:

• Al Masry may participate in EFA events for the season 2012/2013;
• Al Masry’s demotion to the second Egyptian league for the season 2013/2014 is annulled;
• While spectators are banned from Al-Masry’s home games for the next complete season, they are able to attend away matches, with the exception of the next four games against Al Ahly which shall be played without fans on neutral playground which shall be at a distance of 200 km from Cairo or Port Said;
• Al-Masry remains banned from holding games in the Port Said stadium for four calendar years;
• In the event that Al Masry completes part of its sanction during one or several seasons which get interrupted, such partial enforcement shall be deducted from the next complete season which shall be played.

The full arbitral award, with the grounds for the Panel’s decision, will be notified to the parties in due course.

Misirda cok kisinin öldügü bir mac olmustu, belki hatirlarsiniz.

O olaylardan sonra Al-Masry takimini 2012-13 sezonlari icin ligden cekmisler. 13/14 sezonundada 2. ligten baslamasini karar vermisler ve tüm maclarini seyircisiz oynama. Ayrica kendi stadyumunda oynayamama yasagi almis.

Simdi bu ayin 23. CAS ara kararlar vermis ama daha nihai kararlarini vereceklermis.

Al Masry kulübünün ligden cekilmesini iptal etmisler ve oynamasina izin vermisler.
Ikinci lige düsmesini iptal etmisler.

Yani simdi bu olayin nasil bir olay oldugunu ben yorumluyamam. Burda insanlar ölmüs ve büyük bir olay idi. Cok özel bir durum oldugundan mi ilgileniyorlar yada baska nedenlerden dolayi mi bilmiyorum. Ama acik olan CAS ülke federasyonun verdigi kararlari iptal etmis olmasi.

Simdi hem CAS'a dava acamaz diyoruz hemde bu olay var. Ortada bir uyusmazlik var ve ben saatlerdir bu durumu cözemedim.

2009 yilindan sonra Misir futbol federasyon talimatlari degistide mi böyle bir karar alabildiler bilmiyorum acikcasi.

Nihai olan bir sey olmadigi icin simdilik yorum yapmak yanlis ama sanki bir umut varmis gibi.
